BASIC INFORMATION YOU SHOULD KNOW

The “Non-Creamy Layer” (NCL) is a term for people in the OBC group who are still having trouble with money and social issues. The government knows that these people really need help, which is why they can get reservation benefits in jobs and schools. If your family’s yearly income is less than ₹8 lakh, your parents work regular jobs or do small-scale work, and you don’t come from a family with high-ranking government jobs, then you fall into the NCL category. The NCL classification makes sure that the system gives direct help to people who are currently having a hard time and really need it.

Creamy layer means that the people inside OBC category who are already kinda “set” – like good money, decent education, life sorted type, they won’t get reservation benefits. In simple words , those who already came up dont need another push. This concept first came in 1971 (from Sattanathan commision), then later discussed in court cases too, specially that Indra Sawhney case type. Then it was decided to keep creamy layer out of reservation . Income limit also kept increasing with time — first it was 1 lakh then 2.5 lakh , then 4.5, 6 lakh… now its somewhere around 8 lakh per year (parents income). And one more thing – in 2024 court said that creamy layer type system can apply in SC/ST too, meaning those who became more strong can be separated.

Document Required To Apply NCL

Before starting your online application, ready the following documents (JPG/PDF, under 350KB):

• Aadhaar Card: (Linked to your mobile number).
• Valid Caste Certificate: Issued from the RTPS portal.
• Valid Residence (Domicile) Certificate: Issued from the RTPS portal.
• Valid Income Certificate: Issued within the last 6 months (must show family income below ₹8 Lakhs).
• Form-XI: The official RTPS declaration signed by you or your parents.
• Passport Size Photograph: Recent and clear.

NOTE: You will need these documents to apply for a State-level NCL certificate via the RTPS portal at the Block level.

• These are the people who are already little rich / set in life
• Parents income is high (approx 8 lakh+)

Non-Creamy Layer (NCL):

• These are people who are still behind financially/socially
• Inside income limit (less than 8 lakh)
  
  They get reservation.

Example: Person A → dad govt officer + income 10 lakh Creamy Layer → no reservation

Person B → dad small work + income 2-3 lakh Non Creamy Layer → will get reservation

Creamy = already went ahead
Non-Creamy = still need support

Diffrence between State and Central NCL Certificate?

There is a slight difference between these; they are not exactly the same. Central and State NCL operate as two different systems. Therefore, the certificates required for both can also be different.

The NCL (Non-Creamy Layer) is categorized into 2 types:

• Central NCL
• State NCL

What is Central NCL?

This is used in central government jobs and in central educational institutions (like SSC, UPSC, NEET, central universities, etc.). To get a reservation in Central Jobs, institutions, etc. It follows the central OBC list criteria, and the income limit here is usually the standard 8 lakh criteria.

What is State NCL?

This is used for state government jobs and state-level colleges. To get a reservation in State jobs, institutions, etc. Every state has its own set of rules and its own separate OBC list. Sometimes the income rule is exactly the same, but sometimes it can vary a bit depending on the state.

Important Point (where most people get confused): It is very possible that you fall under the state OBC list but not the central OBC list. This means you will get reservation benefits in your state, but not in central-level jobs or exams.

Why was this concept introduced?

The logic was simple: people who are already financially and socially strong tend to take all the benefits, leaving the truly poor with nothing. That is why the upper-tier OBCs were left out, so that the groups that are really underprivileged finally get a fair chance.

When did this start?

• 1971 → The idea came up for the first time (Sattanathan Commission).
• 1992 → The Supreme Court properly implemented it (Indra Sawhney case).

NCL income limit ?

The rules about the income limit can be a little hard to understand, but they follow a clear pattern over time:

• The income limit was first set at only ₹1 lakh.
• This limit was slowly changed and raised over the years.
• Right now, the threshold is about ₹8 lakh per year, which is based only on the parents income.

If your family’s yearly income is more than ₹8 lakh, you are no longer in the “non-creamy layer” and are now in the “creamy layer.”

Is income the only deciding factor?

No, actually. This is a very important point.

The court said:

It can’t be based on money alone. A person’s job, status, and official position are also important.

For example:

• Kids of IAS officers
• Kids of judges

People who work for the private/government at a high level, these people can automatically move into the creamy layer.

Does it apply to SC/ST categories?

In the past, it didn’t. Only the OBC group could use the creamy layer rule. But in 2024, the Supreme Court said that state governments should also start figuring out who is in the “creamy layer” of the SC and ST groups. That said, it’s still not clear how this ruling will be put into action on the ground, and it hasn’t been fully worked out yet.

Can only people from the OBC category benefit from NCL?

Yes, that completely TRUE. NCL stand for Non-Creamy Layer, this group is only for people with lower family income who are in the OBC category.

People who are SC/ST or General cannot get this benefit. In short, it is a special reservation quota made just for people in the OBC category, and only those who fall under the NCL bracket can use it.

What about the General Group?

Persons in the general category cannot apply for NCL.

Why do some people get the benefit of an NCL certificate at the state level but not at the central level?

Every state prepare their own caste list and is free to add or remove from the list. This happens when your caste is available in the state list but is missing from the central list.

Let’s understand with an example:

Let’s suppose you live in Bihar—

• The Bihar government says → Yes, you are OBC.
• But your caste is not in the central government’s list.

what happens next?

• You will get reservation benefits for jobs and colleges within Bihar.
• But you will not get reservation benefits for central exams like UPSC, SSC, or NEET (all-India level).

Why does this happen?

This happens becausea reservation

• The state government prepares its own separate OBC central
• The Central government prepares its own separate list.

They are not always the same. A specific caste might be considered OBC by the state, but the center might not recognize it as OBC.

Here is another scenario:

Suppose your caste is actually present in both lists. But you only got a State NCL certificate made.

Even then, you will face a problem:

• It will work perfectly for state-level forms.
• But for central applications, they will reject it and say → “You need to bring the certificate in the proper central format.”

Why are different levels of NCL verification needed, and when are they used?

These levels are just for checking purposes. NCL also passes through this exact same system; it is pretty much the same scenario as getting an income, caste and residence certificate. Basically, these are just verification levels; it decides which officer will check our form.

Block level (RO / Circle Officer)

• Most of the applications start from here.
• All the basic checking happens here (like income, caste, and documents).
  

SDO level (Sub-Divisional Officer):

• This is a bit higher level than Block.
• The form goes here only if the case is a little complex or if the district has some specific rule.

DM level (District Magistrate):

• This is the topmost authority.
• Normally files go here only when some high-level approval is needed or there is a big issue.

If you apply for it (through the RTPS portal). Verification happens at the block level. Then approval is granted. And your certificate gets generated. It is not compulsory to go to SDO/DM level every time. It goes to the upper level only if there is a need.

• For big problem → DM Level

Follow the exact steps to apply for an NCL certificate in Bihar through the RTPS ServicePlus portal:

Step 1: Open the Official Website

• First, open Google or any browser on your mobile or laptop. If you are filling the NCL application on a mobile, it is better to turn on desktop view.
• Search for RTPS ServicePlus Bihar.
• Open the official website (serviceonline.bihar.gov.in).

Step 2: Go to Online Application

• On the homepage, you will see the option “Online Apply.”
• Under that you will see RTPS services.
• Then select the General Administration Department.

Step 3: Select NCL Certificate Option

Here you will see options like

• Residence Certificate
• Income Certificate
• Caste Certificate
• Non-Creamy Layer Certificate

For Bihar-level NCL, click on: “Non-Creamy Layer Certificate (For Bihar Government Purpose)”. If you need Central level NCL, choose the central option.

Step 4: Choose Certificate Level

NCL certificate can be made at three levels:

• Block Level (Anchal)
• Subdivision Level
• District Level

You should select Circle Level (Anchal). This is valid for most of use or Bihar government forms.

Step 5: Fill Basic Details

If you are a student, then fill in your father’s income details.

If you have multiple sources of income, then you should enter your income from each source in the respective section, along with the amount. If there is only one source, then write the income next to that single source.

Select if you have filed income tax in the last 3 years. This is not mandatory to be filled; if not required, leave it.

Step 9: Upload Required Documents

You need to upload 4 documents out of the 5:

• Form-XI (Affidavit)
• Form-XIII-Residence Certificate
• Form-IV-Caste Certificate
• Form-XVI-Income Certificate
• Percentage of irrigated land (under the ceiling law of the Government of Bihar)
  (If you have land-related documents (like a land receipt), you can upload. If not, you can skip this step. It is not necessary to upload this document.)

Form 11 is a simple affidavit where you:

• Write your name, father’s name
• Address details (village, post, block, district)
• Mention your caste.
• Write parents’ income (if none, write “Zero”).
• Add place, date, and signature.

• Enter the CAPTCHA code.
• Click on “Proceed.”
• Check the preview carefully.

After processing, a preview of your application will be shown. Check all the details carefully. If you find any mistakes, you can edit them at this stage—once you submit, you won’t be able to make any changes.

If everything is correct, click on “Attach Annexure” and upload the required documents. Then click on “Save Annexure”, and proceed to the final submit.

After submission, you will see the Acknowledgement page. From there, click on “Export as PDF” to download your application.

Processing Time:

It usually takes around 21 days. You will also see the expected date of certificate issue in your acknowledgement receipt.

When you are on the RTPS homepage, look at the right-hand side of you desktop screen Under the Citizen section, you will find an option Track Application Status. Click on it to view your application status. (If you are using a mobile phone, scroll down the page. You’ll find the same option under the Citizen section there.)

Here, select “Through Application Reference Number.” Then two more sections will appear there.
